The recovery of utility payments allows resource providers and management organizations to recover unpaid funds for services rendered. In Uzbekistan, debts for water, electricity, gas, heating, and the maintenance of apartment buildings can be recovered through pretrial and court proceedings. The result depends on the correctness of the calculations, the completeness of the documents, and the timely application of the mechanisms provided for by law.

Law on the recovery of utility bills

The legal basis consists of the Housing Code of the Republic of Uzbekistan, the Civil Procedure Code, the rules for providing communal services, and special regulatory acts. According to Article 133 of the Housing Code, mandatory utility payments include payments for cold and hot water, sewage, electricity, gas, heating, and the removal of household waste. Owners, employers, and tenants shall pay for services in accordance with legislation and agreements with suppliers. Article 134 establishes payment deadlines and liability for delay. For individuals, the penalty is 0.1% of the overdue amount for each day, and for legal entities, 0.4%, but not more than 50% of the overdue payment amount. The application of these rules must be verified taking into account the type of service and existing special regulations. An important change was made by the Law of the Republic of Uzbekistan No ZRU-993 dated November 7, 2024. He specified the list of documents for applying for a court order to recover mandatory payments from the owners of premises in multi-apartment buildings. For a service provider, it is important not only to record non-payment but also to prepare evidence that allows for confirming the amount of claims and the legal grounds for recovery.

1. Verification and calculation of debt

In the first stage, the personal account, accruals, incoming payments, meter readings, and the period of debt formation are verified. The correctness of applied tariffs, recalculations, and penalty accruals is checked separately. If the debt relates to several services, it is advisable to divide the settlements into suppliers and periods. This reduces the risk of errors and simplifies the preparation of documents for the court.

2. Pre-trial recovery

A written demand for payment is sent to the debtor, specifying the amount of the debt, the period of its formation, and the repayment period. It is important to save the notification receipt confirmation. At this stage, you can offer voluntary repayment or an agreed payment schedule, if permitted by applicable regulations. Negotiations are especially useful when there is massive debt: some of the debts can be recovered without legal costs and lengthy proceedings.

3. Appeal to the court

If the debt is not repaid, the recoverer selects an appropriate judicial mechanism. If there are documentary grounds provided for by law, it is possible to apply for a court order. If the debtor disputes the accruals, the volume of services, or the obligation to pay, a lawsuit may be required. To recover mandatory contributions and payments from the owners of premises in a multi-apartment building, the Law provides for the attachment of the following documents to the application: No
● decisions of the general meeting of owners regarding the choice of house management method;
● management agreement, if it has been concluded;
● calculation of debt indicating the period;
● information confirming the delivery of the payment request.
For other utility debts, the set of documents is determined by the nature of the claim and the applicable procedural norms.

4. Enforcement proceedings

After receiving the enforcement document, the recoverer applies to the Compulsory Enforcement Bureau (CEB). Within the framework of enforcement proceedings, the measures provided by law aimed at the execution of a judicial act are applied, including the foreclosure of the debtor's funds and property if there are legal grounds. Receiving a court decision does not guarantee the immediate receipt of money. Therefore, it is important to monitor the transfer of the enforcement document, the progress of the proceedings, and the actual repayment of the debt.

Features of debt collection in Tashkent and regions of Uzbekistan

The general legal procedure for recovery applies throughout the country, but the organization of work depends on the category of consumers, the structure of debts, and the availability of supporting documents. In Tashkent, managing organizations of apartment buildings may face a large number of personal accounts and long periods of non-payment. In such cases, it is useful to divide the debt into terms, amounts, and document availability to determine priority matters. The same basic legislative norms are applied in Samarkand, Bukhara, Namangan, Andijan, and other cities. At the same time, for each case, it is necessary to consider the specific supplier, contractual relations, territorial jurisdiction, and available information about the debtor.

Practical conclusion: it is more effective to start by verifying data and eliminating errors in calculations. The mass filing of applications without prior verification may lead to documents being returned, debtors' objections, and additional costs.

Analytics: Why is it difficult to recover utility debts

The main problem is not only the lack of payments but also the quality of debt accounting. If an organization cannot confirm the debt period, the correctness of the calculation, or the presentation of the claim, recovery becomes complicated even with actual non-payment. In practice, it is useful to divide the portfolio into three categories: debts with a full set of documents, debts requiring reconciliation, and disputed charges. The first category is suitable for priority claims and judicial proceedings. Secondly, it is necessary to restore the documents and clarify the calculations. According to the third, it is necessary to determine the legal position and evidence in advance. This approach allows resources to be directed toward matters with the most understandable return prospects, rather than processing all personal accounts identically.

How to increase the effectiveness of enforcement

The following procedure is recommended for systematic debt management:
● Form a register of debtors by amount, period, and type of utility service.
● Conduct a reconciliation of accruals, payments, and documents confirming the obligation.
● Send payment requests and record their delivery.
● Determine the appropriate procedure for judicial recovery and prepare the necessary materials.
● Transfer the enforcement document to the BPI and monitor the progress of execution.
● Regularly update the registry, reflecting incoming payments and the remaining debt.
If an organization operates with a large portfolio of overdue debts, it is advisable to establish a unified process from initial notification to enforcement proceedings.

When to engage debt collection specialists

Professional support is especially relevant if the debt has accumulated over a long period, debtors dispute the accruals, documents require restoration, or independent claim work yields no results.
